Terms of Service
Summary. These Terms are the agreement between you and Wisal. They explain who may use the App, the licence we grant you, the rules for using it, how subscriptions and payments work through Google Play, the limits of our responsibility, and the law that governs any dispute. Please read them before you use the App.
These Terms of Service (the “Terms”) govern your access to and use of the Wisal mobile application and any related content, features, and services (together, the “App”). The App is operated by Hussam Banuwas, an individual developer based in Riyadh, Kingdom of Saudi Arabia (“we”, “us”, “our”). You can reach us at admin@atharquran.org.
By downloading, installing, accessing, or using the App, you confirm that you have read and agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not download or use the App.
1. Definitions
- “App” — the Wisal application and all of its content, features, and services.
- “Content” — all material made available in the App, including Qur'anic text, translations, tafsir, tadabbur, hadith, seerah, audio, text, graphics, and software.
- “User Content” — anything you submit, post, or share in the App, including profile details, comments, challenges, and interactions within community or “close circle” features.
- “Subscription” — a paid plan that unlocks premium features, billed through Google Play.
- “Google Play” — the Google Play Store and Google Play’s billing service, operated by Google LLC.
2. Eligibility and age
Summary. You must be at least 16 to use the App. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
The App is not directed to children under 16, and we do not knowingly allow them to create accounts. By using the App you confirm that you are at least 16 years old and legally able to enter into these Terms. If you are between 16 and the age of legal majority in your country, you may use the App only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.
3. Your account Some features require an account. You agree to provide accurate information, keep your credentials confidential, and remain responsible for all activity under your account. Tell us promptly at admin@atharquran.org if you suspect unauthorised use. We may refuse, suspend, or terminate an account that we reasonably believe breaches these Terms or applicable law.
4. Licence to use the App Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use the App for your own personal, non-commercial purposes on a device you own or control. We reserve all rights not expressly granted.
5. Acceptable use
Summary. Use the App lawfully and respectfully. Do not misuse it, attack it, copy it, or use it to harm others or the sanctity of the content.
You agree not to:
- Break any law, regulation, or third-party right while using the App;
- Copy, modify, distribute, sell, reverse-engineer, decompile, or create derivative works from the App or its Content, except as the law expressly permits;
- Disrupt, overload, probe, or attempt to gain unauthorised access to the App, its servers, or related systems, or introduce malware;
- Use bots, scrapers, or automated means to access or extract Content without our written permission;
- Remove or obscure any proprietary notices, or misrepresent your affiliation with us;
- Treat the religious Content disrespectfully, or alter it in a way that distorts its meaning or the reverence it is due.
6. User Content and community features
Summary. You own your User Content, but you give us permission to host and display it so the App can work. You are responsible for what you share, and we may moderate or remove content and accounts that break the rules.
The App may include social and “close circle” features such as shared challenges and interactions. You retain ownership of your User Content. You grant us a worldwide, non- exclusive, royalty-free licence to host, store, reproduce, and display your User Content solely to operate, provide, and improve the App. This licence ends when you delete the User Content or your account, except for copies retained for legal, backup, or safety purposes, or already shared with others.
You confirm you have the rights to share your User Content and that it does not infringe anyone’s rights. You must not post content that is unlawful, deceptive, hateful, harassing, sexually explicit, violent, defamatory, or that disrespects any faith, scripture, or community.
We have no obligation to monitor User Content, but we may review, moderate, restrict, or remove it, and suspend or terminate accounts, at our reasonable discretion to enforce these Terms or protect users.
7. Interactions with other users
Summary. Connecting with others is at your own risk. We do not control other users and are not responsible for their conduct.
You are solely responsible for your interactions with other users. We do not control, verify, or take responsibility for the identity, conduct, content, or accuracy of other users. Use good judgement, protect your personal information, and report anything that concerns you. To the fullest extent permitted by law, we are not liable for any loss or harm arising from your interactions with other users, and you release us from claims, demands, and damages of every kind arising out of or connected with any dispute between you and another user.
8. Religious and educational Content
Summary. Wisal is a tool for personal study, reflection, and habit-building. It is not a source of religious rulings (fatwa) and does not replace a qualified scholar. Verify matters of religious practice with trusted, qualified scholars.
The App presents the Qur'an together with translations, tafsir, tadabbur, hadith, seerah, and related material, and may use automated or AI-assisted features to personalise this content. This Content is provided for personal study, reflection, and spiritual benefit only.
- Translations and interpretations are necessarily approximate; the Arabic Qur'an is the authoritative source, and meanings may not transfer fully into other languages.
- Scholars hold differing views on many matters; the App may present a particular view that is not the only valid one.
- The App does not issue fatwas and is not a substitute for guidance from a qualified, trusted scholar. You should verify matters of belief and practice (fiqh) with such a scholar before acting on them.
- AI-assisted or personalised features may occasionally produce incomplete or inaccurate output; treat them as a study aid, not a religious authority.
We work to present Content faithfully and accurately, but to the extent permitted by law we do not warrant that it is free from error, and we are not responsible for decisions you make based on it.
9. No professional or medical advice The App and its Content are provided for general informational and spiritual purposes and are not medical, psychological, legal, or financial advice. The App is not a healthcare, counselling, or crisis service. If you are in distress or need professional help, please contact a qualified professional or your local emergency services. Nothing in the App is intended to diagnose, treat, or replace professional care.
10. Subscriptions, payments, and Google Play Billing
Summary. The App is free to use with optional paid Subscriptions. Subscriptions are sold and billed through Google Play, renew automatically, and are managed in your Google Play account.
The App offers a free tier and optional paid Subscriptions that unlock premium features. All purchases are processed through Google Play’s billing service; we do not collect or store your full payment-card details. Your purchase is therefore also subject to the Google Play Terms of Service.
- Auto-renewal: Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the current period ends.
- Pricing: The price, billing period, and currency that apply to you are shown in the App and on Google Play at the time of purchase, and those displayed amounts govern. Prices may vary by region and may change as described below.
- Managing or cancelling: You can view, manage, or cancel a Subscription at any time in your Google Play account settings (Subscriptions). Cancelling stops the next renewal; you keep premium access until the end of the period already paid for.
- Free trials: If we offer a free trial, unused trial time is forfeited when you start a paid Subscription, and the trial converts to a paid Subscription unless you cancel before it ends.
11. Refunds and price changes Because purchases are processed by Google Play, refunds are handled under Google Play’s refund policies and any consumer-protection rights you have under the law that applies to you. We may also offer refunds at our discretion. Nothing in these Terms removes statutory rights that cannot be waived (for example, mandatory consumer rights in your country).
We may change Subscription prices. Where the law requires, we will give you advance notice and the chance to cancel before a price change takes effect. Continued use after a change takes effect means you accept the new price.
12. Feedback If you send us ideas, suggestions, or feedback about the App, you agree that we may use them freely — without restriction, attribution, or any obligation or payment to you — to operate and improve the App.
13. Intellectual property The App and its Content (excluding your User Content and excluding the sacred text of the Qur'an itself, which belongs to no person) are owned by us or our licensors and are protected by intellectual-property laws. The “Wisal” and “Athar” names and logos are our marks and may not be used without our prior written permission. Except for the licence in Section 4, these Terms grant you no rights in the App or Content.
14. Reporting content and intellectual-property complaints We respect intellectual-property rights and the integrity of religious content. If you believe any Content or User Content infringes your rights, is inaccurate, or is objectionable, email admin@atharquran.org with enough detail for us to locate and review it. We will review valid reports and may remove content or take other action at our reasonable discretion, and we may suspend or terminate accounts for repeated or serious violations.
15. Third-party services and content The App relies on third-party services (for example, Google Play, hosting, analytics, crash reporting, and payment processing) and may link to third-party material. We are not responsible for third-party services or content, and your use of them is governed by their own terms and policies.
16. Privacy Your use of the App is also governed by our Privacy Policy, which explains what data we collect and why, including how we handle data that reveals your interest in religious texts (a special / sensitive category) on the basis of your explicit consent. Please review it carefully.
17. Availability and changes to the App We may add, change, suspend, or discontinue features of the App at any time, and we do not guarantee that the App will always be available, uninterrupted, or error-free. We may release updates that you need to install to keep using the App.
18. Disclaimers of warranties To the fullest extent permitted by law, the App and all Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will meet your requirements, that defects will be corrected, or that the Content (including translations, tafsir, and AI-assisted output) is complete, accurate, or suitable for any particular decision. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
You use the App at your own risk, and you are responsible for any decisions or actions you take based on it.
19. Limitation of liability To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or spiritual or other intangible losses, arising from or related to your use of (or inability to use) the App. Our total aggregate liability for all claims relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim, or (b) USD 50 (or its equivalent). These limitations apply even if a limited remedy fails of its essential purpose, and the disclaimers and limitations in these Terms are a fundamental basis of the bargain between you and us.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for fraud, for death or personal injury caused by negligence, or for non-waivable consumer rights.
20. Indemnification To the fullest extent permitted by law, you agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the App, your User Content, or your violation of any law or third-party right, including claims brought by other users or third parties. We may assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence.
21. Suspension and termination You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or applicable law, if required for security or legal reasons, or if we discontinue the App. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
22. Changes to these Terms We may update these Terms from time to time. We will post the revised version with a new “Last updated” date, and for material changes we will give additional notice where required. Your continued use of the App after the changes take effect means you accept the updated Terms.
23. Governing law and disputes
Summary. These Terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes are handled by the competent courts in Riyadh — without removing any mandatory consumer rights you have where you live.
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law rules. The competent courts of Riyadh, Kingdom of Saudi Arabia, will have jurisdiction over any dispute, except where the law that applies to you as a consumer gives you a non-waivable right to bring proceedings in your country of residence or to rely on its mandatory protections.
24. App store and Google You obtain the App through Google Play and your use is also subject to Google’s applicable terms. Google is not a party to these Terms and is not responsible for the App or its Content. These Terms are between you and us only.
25. General
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
- Severability: if any provision is held invalid, the rest remain in force.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or transfer of the App.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
